Apple advertises its products as magical. They’re at the intersection of “technology and the liberal arts,” Steve Jobs said today. Something that moves your heart, not just your lust for technology. Will consumers still buy that in 2011?


The big picture question of the day is whether Apple has done it again. With the original iPad, Apple crushed its rivals, taking more than 90 percent of the tablet market in 2010 and selling more than 15 million units. Jobs predicted today that 2011 will be the year of the iPad 2. Based on what I have seen today, I think he’s mostly, but not entirely, right.


Competitors will discover that Apple has a lot of inherent financial advantages, including being a low-cost leader. That may not sound intuitive, but I believe it has to be true. It is selling so much volume of its products that it can get discounts on parts and manufacturing services that no one else can get.


When it sells its products in stores, it also doesn’t have to give away 20 percent of the margin to a retailer. That is a huge financial advantage. Carriers are also willing to subsidize the costs of Apple products in a way that they won’t with other tablet vendors. All of these things may explain why the Motorola Xoom, a very cool product, is selling for $800 while Apple has priced its new devices at $499 to $829, (and dropped the price of the old iPad to $399). Apple has also left very little room for rivals here, since it has signed up both AT&T and Verizon. Perhaps there is room for rivals to sell $199 machines, but users probably aren’t going to like them.


Those are reasons why any cool Apple mobile product could beat other rivals. But Apple has also done some smart things with the iPad 2. It has created another rev of its microprocessor, the A5, which has two cores, or computing brains. And it has nine times faster graphics than its old A4 chip. Since Apple designs this chip itself, it doesn’t have to give away much margin to a chip design firm. It only has to give a small margin to a chip manufacturer such as Samsung to make the chips.


Apple has also custom-designed the A5 to run Apple applications on a device with a 10-hour battery life. Apple should have an edge there, as it won’t sell the A5 to rivals. But if this is an advantage, it isn’t likely to last long, as Nvidia is being very aggressive with a new quad-core chip that it could sell to any Android rivals.


The design of the iPad 2 is where Apple has more advantages. The iPad 2 will have faster web-browsing with a new version of Safari. It has two cameras that will inspire a lot of video and photo-related apps. The availability of the Mac applications — iMovie, Garage Band, and Photo Booth — on the iPad 2 will make a lot of users happy. More interesting features will come with new releases of the iOS, or Apple’s operating system in the fairly near future.


There are some users who won’t like the restrictions of Apple’s ecosystem. If they want universal serial bus (USB) and SD card ports, they are out of luck. Apple didn’t change the resolution of its screen either, leaving it at 1024 x 768. Competitors could add these options and put emphasis on them as selling points. (Critics are disappointed that Apple did not improve the display, but that’s a big cost issue others have too).


Apple has also made great improvements in the feel of the product. It’s 33 percent thinner, 2 ounces lighter, and it has a wonderful new screen cover that doubles as a stand for the device. (It wakes up the device when you peel it back and it has micro-fibers that clean the screen when the cover is on).


Now here is why Jobs is not entirely right. Apple has come up with a stunning machine at prices that the competitors will have a hard time beating. But it is almost inevitable that Android-based tablets will gain market share on Apple.


So far, I don’t see the Android machine that will beat the iPad 2. But the potential is there, given ingredients such as Android 3.0, Nvidia Tegra 2 chips and other fast microprocessors, and 4G LTE. The latter is the main weakness in Apple’s armor.


LTE is fast, with a minimum speed on Verizon at around 12 megabits a second and actual speeds running much higher than that now. Getting access to 4G LTE is as big a benefit as having access to lots of cool apps, from my point of view. Right now, the timing of the still-young LTE technology means that Apple cannot yet put it into its mass-produced, lowest-cost tablet computers.


If LTE costs come down sometime soon, then Apple can launch a new version of the iPad to incorporate the technology. But it’s not a simple upgrade, as it means that the hardware of the machine — including the radio chip — has to change. And for now, LTE chips are larger than their 3G equivalents, so the heat dissipation and product size are affected. In other words, LTE can force Apple to redesign the iPad.


Apple can do that. But Android tablet makers might be able to move faster than Apple directly into the 4G LTE tablet market. If they do that, then they will have found a scenario where they could steal a march on Apple. Apple is not likely to let that gap last for a long time, but it might be enough for Apple to lose some share this year.


Apple’s leadership position in this market will be hard to beat, but the collective weight and reach of Android rivals could erode it. And here’s a sobering thought: If Apple eventually winds up with only 30 percent of the tablet market, it could still be No. 1, and its place as the largest technology company in the world will not be at risk.

Over the next year or two, social commerce will disrupt e-commerce and social media, effectively turning our social interactions into commercial transactions. So how will this happen and where is the disruption taking place?


A Check-In Economy


You’re walking down the street staring at your phone and it’s telling you what deals are nearby. Perhaps not the best of visions but it’s the ecosystem that currently exists around check-in services like Foursquare and Facebook Places. The features are great, but staring at your phone could result into you running into something or even something running into you. It’s not elegant. The result has been an experience based on check-ins that take place when the consumer arrives at a venue.


Foursquare and Facebook both provide platforms that enable businesses to present deals or offers to visitors, in addition to rewarding visitors for repeat business. It’s an interesting business model and so far it appears to be having decent success. However, as deals disappear and users get tired of checking in, one has to wonder if this is truly the holy grail of social media marketing. If you want to know my opinion: it’s not. Check-ins are an early phase (reviews on Yelp were probably first) in a long shift which will completely disrupt commerce as we know it.


Will normal commerce continue to exist once social commerce takes hold? Definitely! However, a large portion of commerce will become much more integrated with our existing communication.


The Main Players


The goal for any business is to get more customers and more transactions (check-outs) and any new form of commerce will have to accomplish two things: It will need to empower the consumer and help transactions become frictionless. So if we examine all existing solutions through this lens, we should be able to determine how disruptive they truly are. Let’s take a look at a few.


Yelp

Yelp is one of the earliest innovators in the social commerce space. The site has empowered consumers through the amplification of their voices. Suddenly any consumer could instantly have a large (and targeted) audience of potential customers for the business they’re reviewing. Getting bad service? Try threatening the hostess or waiter with a bad Yelp review and see what they do. On a scale of one to ten, Yelp deserves a rating of ten when it comes to empowering the consumer.


As for transaction friction, Yelp has simply integrated with Open Table in order to make reservations easier. That’s about all the site has right now as far as I know, so I’d have to rate them a three on the empowerment scale.


Groupon & LivingSocial

The other major disruptors to online commerce lately have been Groupon and LivingSocial. So far though there’s very little that’s social about these services aside from them making it possible for users to share deals with others. That capability alone has helped grow these two companies to their current values in the billions. The two companies have empowered consumers through the power of numbers.


Consumers get a discounted price for a product or service, and the business gets a massive flood of new customers. While this strategy is rapidly becoming blemished with consumer and business complaints, it has proven to be extremely profitable. Shoppers also love getting a deal so it’s a win-win most of the time. As such, we’d rank these companies relatively high, like a seven, on the empowerment scale, due to the value provided.


However, the transaction isn’t exactly frictionless. After you make a purchase, you often need to go through a scheduling process, depending on the business. Given that the Groupon and LivingSocial effect can be as overwhelming as the Oprah effect, many businesses find it hard to respond to all the demand. While this model will become more integrated overtime, there hasn’t been a removal of friction for the most part, so we’ll score both companies a one on the frictionless scale.


Facebook Places And Foursquare

Facebook and Foursquare are both interesting in their approach to location and empowering the consumer. With Facebook, users could already complain to their friends. Foursquare, however, required the re-creation of a user’s social graph in order to accomplish the same thing. Ultimately, the business value of Facebook Places and Foursquare are a bit more abstract, giving businesses the ability to reward consumers for various behaviors within a given venue.


The existing rewards programs are reminiscent of traditional coupons, making them valuable for a segment of the population. While I’ve heard people extoll the values of creating a Place on Facebook or managing a venue on Foursquare, the return on investment has yet to prove itself.


For Facebook, the value presented by tracking user check-ins is improved advertising, and Deals appears to be more of an afterthought for the company, although that could change in the future. For Foursquare, the value surrounds rewarding consumers for frequenting a business.


Ultimately, I don’t find either of these products to be extremely empowering for the shopper.  The main reason is that once the consumer checks in, they aren’t as likely to change their decision to shop there. Contrast that with Yelp, where a bad review can result in a lost customer. As such, I’m ranking Facebook Places and Foursquare a three on the empowerment scale and a one on the frictionless transaction scale.


While I think both products will evolve over time, this space is still extremely nascent.


The Future


The convergence of local, mobile, and social (or “SoLoMo” as John Doerr calls it) is about to generate a tidal wave of change and we stand on the cusp of it. While I could wax poetic about the future of this space, I’ll simply say that the overall shopping experience will become much more social for a large percentage of transactions. If you think about all the purchases that involve social experiences (movies, concerts, travel, etc), these spaces are only beginning to get disrupted.


While the experiences are social, right now the transactions are not. So far the only social shopping experiences which exist today either provide basic integration with Facebook, sidebar chat with friends during the shopping experience, or other basic features. Over the next one to two years, we will see a wave of innovation in the social commerce space and it won’t be like the forms of interactions we have on the web; they will be completely different. While it’s easy to call the Groupons of the world overvalued, this is a trillion dollar market that is just beginning to unfold.







This was supposed to be an article about monetizing your life as an amateur musician. It’s become an opinion piece on my experience of Google AdSense.

I signed up for Adsense several years ago. I had a travel blog which was general only for family and friends. If I remember correctly, my travel blog made me about £0.05 across 2 years or so.


Fast forward to 2011 and I am trying to investigate means of being a little more business-like about my hobbies (mostly music). By the end of January I had manned up and started to promote my blogs. I had created several different blogs, which were contributed to by friends and colleagues. I promoted these activities through Facebook and Twitter.




After a few weeks, I was looking at around 2,000 hits a month across all my content sources. I was feeling pretty proud of myself. My Google Adsense balance was approaching £10, and I hoped I could make around £50-100 a year. Google then disabled my account.


When your Adsense account is disabled you receive a standard email which tells you there has been "invalid activity". It directs you to a help URL. The only response you can take is to make an appeal.


Taking the matter particularly seriously, I spent some time writing the appeal which outlined my thoughts on the invalid activity. My guess is that I have violated their "don’t click on your own ads" policy when I’ve been proudly showing off my sites to friends and family. Since my IP address is logged on Blogger etc. and my clicks are less than 1% of the total hits received from countries far and wide, I assumed that they would realise my site was genuine.

In Part I of this series we discussed the media's failure to accurately report the scope and nature of the banker crime wave around foreclosure fraud, and talked about the confusion over reports that the Administration has proposed a framework for settling the fifty-state lawsuit against the banks. (Hmm ... wonder why there wasn't a Federal lawsuit, too?)


Is there really an Administration proposal for a deal? Given the number of reports and the absence of denials from the White House, the answer appears to be ... sort of. It seems clear that the Administration's proposing to create a $20 billion fund at the banks' expense which would be used to help underwater homeowners, and that the banks would administer this fund themselves (we'll respond to the proposal outline in Part III of this series). But even that's not 100% certain, since reports suggest that there's still infighting among government agencies.


Reuters reports that the Consumer Financial Protection Bureau (CFPB) and Federal Deposit Insurance Corporation (FDIC) folks are pushing for a larger settlement, but that the Office of Comptroller of the Currency (OCC) thinks the proposed settlement is already too big. All of this alphabet soup is beginning to spell out a slang expression that describes the government's handling of this situation with pinpoint accuracy. That expression begins with "cluster" and ends with the word Melissa Leo introduced to the Academy Awards last Sunday night.


The virtual ink was barely dry on the initial reports of an Administration proposal when Reuters reported that "regulators' efforts to settle with banks over improper mortgage foreclosures are being hampered by disagreements among the groups involved over the size and shape of an accord." Other stories then elaborated on the squabbles among Federal agencies over the scope and nature of the proposed settlement. It seems as if everybody in the Federal government is running to the press so they can put their own spin on a proposed deal.


It looks like we're observing a serious vacuum in leadership during a time of crisis. This vacuum, together with the confusion that's been created in the press as everybody pushed their own agenda, has left the public becalmed in fog-shrouded waters somewhere between Conflicting Viewpoints, Absolute Bewilderment, and WTF.


(Hey, you know what would be great? It would be great if all of these Federal agencies reported to a single person - and that person was empowered to make an executive decision on behalf of the entire executive branch of government. You could call that person the "Chief Executive," or ... but I digress.)


Despite all the confusion, the outlines of the Administration's proposal seem to be coalescing around three main provisions: Banks would have to write down the principal on underwater mortgages with $20 billion of their own money (investors in mortgage-backed securities and other instruments would not be held responsible), and they would implement their own mortgage modification programs. No government money would be used to reduce principal.


Any proposal from the Federal government would have to be accepted by the states before being presented to the banks. Based on what we've learned so far, does this proposal provide the right framework for a comprehensive settlement? We'll save our conclusion for the third and final installment of this series, but here's a sneak preview:

There has been evidence here and there of a marked fall in new foreclosure filings. Lender Processing Services, which handles more than half of the loans serviced in the US, said its revenues in its Default Services Group were down in the final quarter of the year. Why? Its revenues are tied to initial foreclosure filings, and its were off 33%, no doubt in large measure due to the robo signing scandal. Recall that it led many banks to halt foreclosures (some all over the US, others in judicial foreclosure states only) while they inspected the state of play and scrambled to revamp procedures. Banks piously claimed that they found no problems in the correctness of foreclosure actions and that ex making the changes needed to assure affidavits were proper, they were going to be back to business as usual post haste.


Now we already know that that isn’t the case. Since the robosigning scandal broke, foreclosure activity has been down. RealtyTrac reported that foreclosures in January were up only 1% over December levels, which was down 17% from the year prior.


But RealtyTrac captures every foreclosure filing in that particular report, so it is a mix of new foreclosure filings plus additional filings for foreclosures already underway (the number of filings required varies by state, but the minimum number is three, and the number can also be increased if a borrower gets a foreclosure suspended, say by entering into a payment catchup plan, and then has the process restarted later on).


Lynn Syzmoniak of Fraud Digest provides a snapshot for January 1 through January 26 in two counties in Florida, Lee County and Palm Beach County:



Her tally for US Bank over the same period covered only Lee County, but showed similar results: 42 new foreclosures for 2011 versus 143 for 2010.


Now merely eyeballing this sample, and assuming it is representative of Florida (Syzmoniak says other counties show similar patterns), it’s clear the decline is bigger than the 33% fall that LPS mentioned for the fourth quarter of 2010 or the 17% figure from RealtyTrac.


There are reasons why Florida might show a steeper fall than other states. First, the state AG has been investigating all the major foreclosure mills in the state. Some, like the Law Offices of David Stern, have effectively folded. So there could be a bit of disarray simply due to the loss of some processing capacity.


Second, Florida, like New York, has implemented a rule requiring that attorneys verify information provided in foreclosures. That might seem to be merely ceremonial, since lawyers are already responsible for the accuracy of information provided to the court. But I am advised that this measure is more than mere belt and suspenders; it apparently would have the effect of lowering the bar for opposing counsel calling for Rule 11 sanctions if he thought the foreclosing attorney was submitting bogus documents or information. That rule did became effective February 11, 2010 (hat tip Lisa Epstein), and the foreclosure mills have tried to escape compliance. I’d imagine in the wake of the robo signing scandal, their clients are becoming less tolerant of this sort of thing.


If this pattern holds across at least across judicial foreclosure states, it suggests what we have long argued: that failures to convey loans as required by securitization documents are widespread, if not pervasive. Now that servicers and foreclosure mills are finding that a lot of judges no longer take them at their word, which means they increasingly have to provide documentation, they may be finding that a lot of their records do not pass muster. And while document fabrication was once an easy way out, that strategy is a lot riskier than it used to be.

In Saudi Arabia, the royal family has just offered $36 billion worth of concessions in an effort to placate an increasingly unruly public (this appears to be in addition to pledges to spend $400 billion on education, health care, and infrastructure by 2014). This is in a country with a population just under 26 million, including over 5 million non-nationals who presumably aren’t eligible.


Now you can easily pooh pooh this comparison, since Saudi Arabia is an autocratic country desperately throwing around money to buy off dissidents, right? But this is the kind of money a leadership group will shell out when pressed to defend an existing order. And the US was very quick to hand out funds right, left, and center during the financial crisis. It’s continuing to do so now in less obvious ways, by continued life support for the mortgage market through Fannie and Freddie, the Fed’s super low interest rates and QE2, and non-monetary measures, most important its refusal to make any sort of serious investigation into what happened in the crisis and prosecute key actors.


Most observers, yours truly included, had expected very little from the multi-regulator “foreclosure task force” announced last year. It was clearly designed to be an even more cosmetic exercise than the stress test charade, which does take a certain amount of brazenness (or more likely, confidence in the public’s inability to follow the three card monte). But a bad situation devolved; the Treasury had appeared to be in charge, and that department at least tries to put a minimum level of professional spit and polish into its charades. When OCC acting chair and chief bank enabler John Walsh got up to speak in an official capacity about the process in last week’s Senate Banking Committee hearings, it was evident there was not even going to be an effort to pretend that this was a serious undertaking.


Even so, the mortgage “settlement” trial balloon floated in the Wall Street Journal this evening is an offense to common sense and decency. Notice how the word “fraud” is pretty much verboten in the MSM; the latest code word for what went awry is “breakdown”. This implies a benign sort of neglect, simply of not doing sufficient maintenance which led fussy machinery to quit working. This shows how backwards the logic here is. Investors would LOVE principal mods to qualified borrowers; it’s far better than taking 70%+ losses on foreclosures. So saving RMBS investors any pain should never have been a feature of the plan design. And that means it is really a fig leaf for avoiding writedowns on second liens, which are heavily concentrated in the four biggest TBTF banks.


The officialdom is taking the stance that only a small number of borrowers suffered wrongful foreclosures. The HAMP fiasco alone makes that patently untrue. And the regulators’ failure to compare servicer records with borrower records (the short time frame of the task force effort guarantees that did not take place) makes this a garbage in, garbage out exercise. And that’s before you get to the question of fraudulent servicer charges, which foreclosure defense lawyers say represent 50% to 70% of the cases they handle (it’s easier to win based on standing so court records do not reflect the borrower reason for choosing to fight the foreclosure). Without an audit of servicer software, this regulatory assessment was a simple “see no evil” exercise.


Nor do I see any mention of imposing new servicing standards on banks, another massive oversight.


The servicers, as well as Fannie and Freddie, would be required to provide principal mods. But given the meager settlement amount, this is a complete and utter joke. The mods will be too shallow and too few in number to help either borrowers or the housing market. Both J.C. Flowers and Wilbur Ross, both very tough minded investors, have found deep principal mods work, and research supports their views. Why are borrowers going to struggle to make home payments when they still face a loss and/or a big tax bill when they try to sell the home?


If you assume a combined first and second mortgage balance of $200,000 and a mod of 10%, or $20,000, which is too low to make much difference to borrowers and well short of what investors would accept (given 70%+ expected losses on a foreclosure, 25% to even 50% is a no brainer), you get 1,000,000 mods. That sounds peachy until you realize that nearly 30% of the homes in the US, a total of 15.7 million, are underwater and prices are projected to fall further this year. And most are underwater by more than 10%. So even if this works as advertised, who gets help is likely to be capricious and the amount of help will be insufficient.


And as Marcy Wheeler correctly points out, this program is really HAMP 2.0. When a small group of bloggers visited the Treasury last August, HAMP was such an obvious failure that the staff didn’t even try hard to defend it. One of the excuses offered by Geither was that Treasury lacked authority over servicers (a point I disputed, since Treasury has plenty of leverage at its disposal). So there isn’t even any reason to believe the banks (ex perhaps the Fannie and Freddie loans) will live up to their commitment do a paltry number of mods. As Marcy noted:
